JUDGMENT
1. The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking direction in the nature of Habeas Corpus directing the respondents to produce the missing daughter of the petitioner, Ms. ‘P’, before this Court.
2. Status report has been submitted during the course of proceeding by the learned Standing Counsel today and the same is taken on record. A copy thereof has been supplied to the petitioner in Court.
3. Learned Standing Counsel submits that the girl has been traced and is appearing through video conferencing. W.P.(CRL) 3902/2025
4. Ms. ‘P’ appears through video conferencing and submits that she is approximately 19 yrs old, her date of birth being 26.01.2007. Upon being queried, she submits that she has married Mr. ‘A’ and is currently residing in her matrimonial home with her husband in Village Chudali Raipur Sadat, Bijnor, Uttar Pradesh.
5. Copy of marriage certificate has been furnished and same is taken on record.
6. We have also interacted with Mr. ‘A’ (husband of Ms. ‘P’) through video conferencing. He submits that he has completed his 12th standard and is presently preparing for admission in graduation. He further submits that he is resident of Village Chudali Raipur Sadat, Bijnor, Uttar Pradesh.
7. The parents of Ms. ‘P’ have also interacted with her through video conferencing in Court, and she has expressed her willingness to meet them. The contact number and residential address of Mr. ‘A’ have also been furnished to the parents of Ms. ‘P’.
8. As Ms. ‘P’ is major, she is at liberty to stay wherever she wants.
9. In view of above, no further order is required to be passed.
10. The petition stands disposed of in the aforesaid terms.
11. All pending application(s), if any, also stand(s) disposed of.
