JUDGMENT

3. The Petitioner Nos. 1 and 2 – Dr. Prannoy Roy and Ms. Radhika Roy, have filed the present application seeking permission to travel abroad. The application was originally filed seeking permission to travel abroad between 26th May, 2023 to 13th June, 2023. However, it has been submitted by Mr Hariharan, ld. Sr. Counsel that Petitioner No. 2 has taken ill, thus, the Petitioners wish to modify their travel dates. Now, the Petitioners wish to travel from 25th July, 2023 to 15th August, 2023. The submission of Mr. Hariharan, ld. Senior Counsel appearing on behalf of the Petitioner is that the Petitioner wishes to travel for both business and personal reasons to visit the brother of Petitioner No.1.
4. Ld. Counsel for the Respondent opposes the reasons for travelling abroad on the ground that there are investigations currently going on against the Petitioners.
5. The Court has considered the reasons given in the application as also the fact that vide order dated 1st June, 2022, the Petitioners had been given permission to travel. Owing to the professional standing of the Petitioners as also their deep-rooted ties to India, in the opinion of the Court they do not pose a flight risk. Accordingly, they are permitted to travel on the following terms and conditions: i) The Petitioners shall furnish a detailed affidavit before the stay at various stations abroad, telephone numbers and residential/hotel addresses. The Petitioners shall also file an undertaking that they shall adhere to the itinerary mentioned in the affidavit and not visit any other stations; ii) The Petitioners’ contact number shall be kept operational at all times, subject to all exceptions such as the period they are on board the aircraft. iii) The Petitioners shall file a self-attested copy of their passports along with a copy of their visas with the CBI on their return to India; iv) An undertaking shall be filed that they shall return to India not later than 30th August, 2023.
6. Let the updated itinerary of the Petitioners be furnished before the worthy Registrar General.
7. Application is disposed of.
8. List before the Registrar General on 5th July, 2023.
9. List before the Court on 28th July, 2023.
