MINI PUSHKARNA, J. (ORAL):
JUDGMENT
1. The present writ petition has been filed for directions to the respondent No.5 to appoint Total Station Method (TSM) Surveyor immediately in terms of the order dated 17.08.2021 passed by the District Magistrate (DM) (North) in the matter titled as Ajay kumar Vs. Tehsildar (Narela) & Ors. There is further prayer for removal of encroachment from the street/road after demarcation of the area in question.
2. Ld. counsel appearing for respondents submits that a TSM Surveyor has already been appointed by the respondents for the Neutral Citation Number: 2023:DHC:3770 purposes of carrying out demarcation of the area in question. He further submits that the demarcation shall be carried out in due course.
3. I have heard ld. counsels for the parties.
4. Considering the submissions made before this Court, it is directed that since TSM Surveyor for carrying out demarcation has already been appointed by the respondents, the demarcation procedure shall be carried out by the respondents expeditiously, preferably within a period of three months from today.
5. After the demarcation is completed, the concerned authorities are directed to remove the encroachments as may be existing on the street/road.
6. With the aforesaid directions, the present writ petition is disposed of. MINI PUSHKARNA, J MAY 24, 2023
