MINI PUSHKARNA, J. (ORAL):
JUDGMENT
1. After some arguments, Mr. Udit Dwivedi, ld. Counsel for respondent No.1 school submits that the school shall grant admission to the petitioner in Class Nursery in current academic session 2023- 2024 under the EWS/DG category. He further submits that the said statement has been made on behalf of the respondent school, without prejudice to the rights and contentions of the school.
2. Ld. Counsel for Directorate of Education (DOE) submits that an email dated 01.04.2023 has been written on behalf of DOE to the respondent school to grant admission to petitioner child. He submits that once a seat has been allotted by the DOE to an applicant for admission under the EWS/DG category, it is incumbent upon the school to grant admission.
3. Considering the fact that the respondent school is ready to grant admission to the petitioner under the EWS/DG category in class Nursery, it is directed that the petitioner shall approach the respondent school within a period of one week along with the requisite documents.
4. The respondent school is directed to process the documents of the petitioner as and when the petitioner submits the requisite documents and forthwith grant admission to the petitioner in Class Nursery under the EWS/DG category.
5. It is further directed that in case the petitioner faces any difficulty, the DOE shall render its full assistance and cooperation in ensuring that petitioner is granted admission in Class Nursery in respondent school in the EWS/DG category.
6. With the aforesaid directions, the present writ petition is disposed of along with pending application. MINI PUSHKARNA, J JUNE 1, 2023
