JUDGMENT

1. Mr. Suman Malhotra, Advocate appearing for respondent no. 1 school submits that he has instructions to submit that the school will issue School leaving certificates to both the students for Class 3rd and Class 9th for the academic session 2022-2023, along with the result.

2. Learned counsel for the school further submits that the respondent should abide by the undertaking given on the last date of hearing that the petitioner shall deposit an amount of Rs. 1,00,000 towards part payment of the school fees. W.P.(C) 1693/2023

3. Learned counsel appearing for the petitioner submits that part payment of Rs. 1,00,000/- shall be deposited in the school within a period two days.

4. Learned counsel for the respondent school submits that upon deposit of the aforesaid part payment, the school will immediacy release the school leaving certificates to both the children for Class 3rd and Class 9th respectively.

5. In view of the aforesaid, it is directed that upon the petitioner depositing Rs. 1,00,000/- with respondent school, the school shall immediately take steps for issuing the school leaving certificates to the petitioner students for Class 3rd and Class 9th respectively.

6. It is further clarified that the school has the liberty to seek appropriate legal remedies for the purposes of recovery of balance of the school fees.

7. Learned counsel appearing for the petitioner submits that the petitioner students are now seeking admission in a government school. He submits that the Directorate of Education may cooperate with the petitioner in seeking admission of the students in the government school of their choice, in case any problem is faced with respect to admission thereto.

8. The DOE is directed to extend their full cooperation and guidance to the petitioner in this regard.

9. With the aforesaid directions, the present writ petition is disposed of. MINI PUSHKARNA, J MAY 30, 2023
