JUDGMENT

1. The challenge in this writ petition is to an order dated June 01, 2023 passed by Central Administrative Tribunal („Tribunal‟ in short) whereby the Tribunal while considering the interim application has refused to grant any interim relief.

2. Our attention has been drawn to para 5 of the order whereof the Tribunal has observed “However, we are conscious of the fact that the adjudication of interim relief would be no reflection upon the final outcome of the OA”.

3. We have been informed that the next date of hearing before the Tribunal is August 16, 2023. Mr. Praveen Swarup, learned counsel W.P.(C) 8541/2023 appearing on behalf of respondents states that the counter affidavit to the O.A. shall be filed within two weeks. If that be so, granting time of one week to the petitioner herein to file rejoinder, we dispose of the Original Application by directing the Tribunal to hear the Original Application on August 16, 2023 and decide the same as expeditiously as possible, prior to the purported date of declaration of result of re-examination to be held between July 07, 2023 - July 10, 2023, which we are informed, shall be three months thereafter.

4. At this stage, we record the statement made by the learned counsel of the petitioners that the petitioners shall, without prejudice to their rights and contentions in the Original Application, appear in the re-examination.

5. Petition is disposed of with the above directions. Pending applications also stand disposed of.
