JUDGMENT
1. Present bail application has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR no.ED-MV-000754/2022 dated 18.08.2022 at PS ePolice Station (Madhu Vihar, East District) under Sections 380/454/34 IPC. The FIR was lodged on the statement of Seemendra Kumar Gupta alleging therein that the petitioner and one woman accompanying him tried to take away computer and laptop forcefully from his office. When they were tried to be restrained, they misbehaved with the staff of the complainant and threatened to kill him. It was alleged that thereafter the petitioner and woman accompanying him took away his computer and laptop of the complainant. The complainant stated that he had some business dealings with the petitioner.
2. Learned APP submits that in compliance of order dated 28.11.2022 the petitioner had joined the investigation and also handed over the laptop. It has been submitted that the laptop has been released to the complainant. It has further been submitted that now the investigation is complete and the charge-sheet has been filed.
3. Taking into account, the facts and circumstances of the case, in case IO feels necessity to effect the custody of the petitioner, the petitioner may released on anticipatory on his furnishing person bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the learned trial court, subject to the following conditions: a) the petitioner shall cooperate in the investigation and appear before the Investigating Officer of the case as and when required; b) the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case; c) the petitioner shall provide his/her mobile number(s) to the Investigating Officer and keep it operational at all times; and e) in case of change of residential address and/or mobile number, the petitioner shall intimate the same to the Investigating Officer/ Court concerned by way of an affidavit.
4. With the above directions, the petition stands disposed of.
5. Copy of the order be sent to the trial court for information.
