JUDGMENT
1. The present writ petition has been filed with the following prayers: “a. set aside the impugned Order dated 15.03.2023 passed by the Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi in O.A. No.2939/2022; and b. direct the respondents to consider the petitioners against the unfilled/deserted vacancies left out due to nonjoining/resignation of the selected candidates/blocked vacancies for the post of Constable (executive) in Delhi Police advertised vide Notice dated 01.08.2020; and c. direct the respondents to open the sealed cover wherein the reserve list of the candidates has been kept and upload/publish the said list and disclose the names of the candidates falling in the said reserve list; and d. pass any other orders or directions as may be deemed fit and proper in the facts and circumstances of the case and in the interest of justice.”
2. On the last date of hearing, Mr. N.K. Singh, who appeared for the respondents sought time. Today Mrs. Ahlawat, Standing Counsel appears for the respondents would submit that as per her instructions, the result of the selection, which was held to fill up 5846 vacancies of Constables (Exe.) in Delhi Police, was declared on December 15, 2021 and the panel thereof is going to expire on December 15, 2023. She also states that as per the relevant instructions, if a fresh notification for appointment is issued before the expiry of the panel, the panel would cease to operate on the date when a fresh notification is issued.
3. She also state, as per the relevant rules / instructions, a notification need to be issued on or after August 31, 2023. She states that if no notification is issued, the panel shall continue till the date of notification or till December 15, 2023, whichever is earlier. She submits that there are total 126 vacancies existing as on July 31, 2023 and the category-wise being 83 (male) and 43 (female) generated due to reasons, like resignation, death of selected candidates, cancellation of candidature, etc. to the post of Constable (Exe.). She also submits that in order to maintain transparency in the recruitment process, the competent authority has constituted a committee to analyze the data of candidates in reserve panel provided by the SSC in a sealed cover and select 126 candidates strictly according to category / merit-wise against the vacancies generated due to the above reasons and submit its report. She states that further action shall be taken by the respondents based on the recommendations made by the committee.
4. We take on record the submission of Mrs. Ahlawat on instructions and dispose of the petition.
