JUDGMENT
1. Present application has been moved for early hearing.
2. With the consent of the parties, the matter is taken up for disposal.
3. Application stands disposed of.
4. The present petition has been moved under section 482 CrPC seeking quashing of case FIR No. 0496/2022 dated 04.11.2022 registered under sections 452/34 IPC at PS Vasant Kunj, South, New Delhi.
5. The complainant in this case is a senior advocate and senior member of the legal fraternity. The present dispute is between the family members. The complainant Sh. Pravin H. Parekh had lodged the present complaint against his son and daughter-in-law who are the petitioners herein and some other persons. A perusal of the FIR reveals that it was a property dispute between the members of the same family.
6. Learned senior counsels submit that now the parties have reached on an amicable settlement. Respondent No.2 has filed an affidavit stating therein that he has compromised the matter with the petitioners, and he does not wish to pursue the present complaint. He has stated that he has entered into the settlement out of his free will and without any fear, force or coersion.
7. Submissions considered.
8. Section 482 Cr.P.C. preserves the inherent powers of the High Court to prevent the abuse of the process of the court or to secure the ends of justice. Since it was a dispute inter se the family and the parties have decided to settle amicably. I consider that there would be no purpose in continuing with the present complaint.
9. In light of the above, the case FIR No. 0496/2022 dated 04.11.2022 registered under sections 452/34 IPC at PS Vasant Kunj, South, New Delhi and all other proceedings emanating therefrom are quashed.
10. The petition stands disposed of.
