Heard the learned Senior Counsel appearing for the petitioner and the learned Senior Counsel for the respondents.
There is an affidavit dated 25th September, 2021, filed by Shri
Pratik Shreshtha, Vice President of the petitioner, on behalf of the petitioner in which all allegations made in the present petition against the respondent No.5, have been withdrawn.
In view of the withdrawal of the allegations, the learned
Senior Counsel appearing for the respondents states that they have no objection if the subject suit is transferred to the District
Court, Siliguri, West Bengal.
Accordingly, the transfer petition is disposed of by directing that the Title Suit No.11 of 2017 pending before the
District Judge Special Division-I, East Sikkim at Gangtok is hereby transferred to the District Court at Siliguri, West Bengal.
Pending application (s), if any, stand disposed of.
