JUDGMENT

1. Learned Counsel for the parties agreed ad idem that this dispute can be decided by the Armed Forces Tribunal.

2. Accordingly, as the matter has been pending with this Court for over two years as on date, we are not directing the petitioner to institute a fresh petition before the Armed Forces Tribunal.

3. We direct the Registry of this Court to transmit the record of this writ petition to the Armed Forces Tribunal which shall register the W.P.(C) 13383/2023 writ petition as a transfer application.

4. The record of this Court shall be treated as the record of the Armed Forces Tribunal.

5. We direct that the matter be placed before an appropriate bench of the Armed Forces Tribunal on 8 January 2026.

6. On the said date, the parties would present themselves before the Armed Forces Tribunal and would not seek any adjournment.

7. Writ petition is disposed of accordingly.
