JUDGMENT

1. Learned Counsel for the parties have ad idem agreed that this dispute is amenable to adjudication by the Armed Forces Tribunal[1].

2. As the case has been pending for three years, we are not requiring the petitioner to reinstitute the petition before the AFT.

3. We direct the registry of this Court to transmit the record of this case to the AFT within a period of two weeks from today.

4. The petition as and when received shall be registered as a Transferred Application and shall be listed before an appropriate “AFT” hereinafter W.P.(C) 3500/2025 bench for adjudication.

5. Both sides are directed to appear before the concerned bench of the AFT on 12 January 2026.

6. The record of this Court, thus far, would be treated as the record of the AFT.

7. The petition is disposed of accordingly.
