Heard learned counsel for both sides and perused the record.
Considering the facts and circumstances of the case, this
Court is of the opinion that request for transfer of proceedings from the Court of 3rd
Jt. Civil Judge, Senior Division, Bhusawal, Maharashtra, to the Patiala House District Court, New Delhi is justified and is, accordingly, accepted.
Consequently, the Petition bearing H.M.P. No. 114 of 2020, titled as “Komal Dhansingh Patil v. Pranjal Komal Patil”, pending in the Court of 3rd
Jt. Civil Judge, Senior Division, Bhusawal, Maharashtra, is transferred to the Court of the Presiding Officer, Family Courts, Patiala House Courts, New Delhi, who will hear the case himself or assign it to a court of competent jurisdiction.
The Family Court at Bhusawal, Maharashtra is directed to transmit the entire record to the transferee Court immediately.
The transferee Court shall decide the case so transferred as expeditiously as possible and preferably within two years from the date of receipt of the records.
