HIGH COURT OF DELHI
Date of Decision: 13th January, 2026
RIZWAN & ORS. .....Petitioner
Through: Mr. Jai Bansal and Ms. Namrata Kathuria, Advocates.
Through: Mr. Sunil Kumar Gautam, APP for the State
Welcome.
JUDGMENT
1. Petitioners herein seek quashing of FIR No.00154/2021 dated 06.01.2021, registered at P.S. Welcome, under Sections 498A and 406, IPC, along with consequential proceedings, based on compromise arrived at between the parties.
2. Petitioner No. 1-Rizwan got married to respondent NO. 2-Soni @ Salmani on 31.03.2010, as per Muslim rites and ceremonies. On 16.09.2019, respondent No. 2 filed a complaint before DCP, North-West District, Seelampur, Delhi for registration of FIR against the Petitioners. Pursuant to such complaint, the abovesaid FIR was registered. The chargesheet had, reportedly, been filed.
3. It is apprised that the matter has been amicably settled in terms of settlement deed dated 26.05.2025. CRL.M.C. 269/2026 2
4. The parties have also started living together and, therefore, the complainant i.e. respondent No.2-Ms. Soni @ Salmani is not interested in pursuing her abovesaid criminal complaint.
5. The terms of the settlement have been reiterated by respondent No.2, who is present in person. She has also been duly identified by her counsel Ms. Namrata Kathuria, Advocate, D/13369/2024.
6. Respondent No.2 submits that she has, voluntarily, entered into settlement and that there are no other cases, pertaining to the marriage in question, pending in any Court of law.
7. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is private in nature. In any case, even the complainant does not wish to press any charges against the petitioners and is staying happily with petitioner.
8. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR.
9. Consequently, to secure the ends of justice, FIR No.00154/2021 dated 06.01.2021, registered at P.S. Welcome, under Sections 498A and 406 IPC, along with all consequential proceedings emanating therefrom, is hereby, quashed.
10. The petition stands disposed of in aforesaid terms.
