JUDGMENT
1. The accused/applicant seeks regular bail in case FIR No. 605/2017 of PS NDRS for offence under Section 302/120B/34 IPC.
2. Learned counsel for accused/applicant submits that the prosecution case is pertaining to a blind murder and that there is no incriminating evidence against the accused/applicant.
3. Learned APP assisted by IO/Inspector Yakub Khan fairly admits that there is no incriminating evidence against the accused/applicant, though there is a statement of his presence at the spot and his confessional BAIL APPLICATION 4429/2025 pages statement, which was recorded in another FIR of snatching.
4. Considering the above circumstances, the application is allowed and the accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the learned trial court. Accompanying applications stand disposed of.
5. Copy of this order be immediately sent to the concerned Jail Superintendent for being conveyed to the accused/applicant.
