JUDGMENT

1. None appeared for the appellant yesterday despite the matter having been called out twice.

2. There is no appearance on behalf of the appellant today either.

3. Mr. Mittal, learned Counsel for the respondent, further points out to us that Section 34 petition filed by the appellant has also been dismissed and that possibly this appeal may have therefore been rendered infructuous.

5. Nonetheless, as there has been no appearance on behalf of the appellant, we dismiss the appeal for default and non-prosecution.
