JUDGMENT
1. Mr. Pankaj Kumar, learned Counsel for the petitioner submits that the impugned marks of the respondents, forming subject matter of C.O(COMM.IPD-TM) 134/2022 & C.O.(COMM.IPD-TM) 361/2021 challenge in these petitions preferred under Section 57 of the Trade Marks Act, 1999, have been removed from the Register of Trademarks on account of their not being renewed after they had expired.
2. As such, without prejudice to the right of the petitioner to institute fresh proceedings in case the marks are renewed, he seeks, for the present, to withdraw these petitions.
3. Reserving leave and liberty as aforesaid, these petitions are disposed of as withdrawn.
