1. The present Application under Section 151 of the Code of Civil Procedure, 1908 has been jointly filed on behalf of the parties seeking to take on record the MoU dated 27.09.2023 and grant permission to withdraw the present petition in terms of the said MoU.

2. It is submitted that the matter parties have arrived at a settlement vide MoU dated 27.09.2023. Therefore, a request is made that the present petition may be disposed of in terms of the MoU dated 27.09.2023.

3. A sum of Rs. 67,69,958/- shall be paid by the petitioner directly in the account of the respondent as has been mentioned in the present application dated 02.11.2023 annexed along with MoU dated 27.09.2023. Digitally O.M.P. (COMM) 521/2019

4. The respondent is present in person in the Court. The parties re-affirm that the MoU dated 27.09.2023 has been arrived at between them voluntarily without coercion and pressure and they undertake to remain bound by the terms of the MoU dated 27.09.2023.

5. In view of the submissions made, the present application is allowed, present petition is disposed of in terms of the MoU dated 27.09.2023.

7. In view of the Order passed in Application bearing No. I.A. 22147/2023, the present petition along with pending application is disposed of.
