1. For the reasons stated in the application, the application is allowed. The delay in filing the review petition is condoned.

REVIEW PET. 279/2023

1. Petitioner had impugned order dated 23.06.2023 whereby petitioner had been declared unfit on account of defective distant vision, right eye. This petition was disposed of by order dated 12.07.2023 referring to certain documents which were annexed with the petition inter alia printout of an eye-testing machine.

2. This Court looking at the said document had opined that petitioner did not have perfect vision as was required and the documents recording his vision as 6/6 was apparently with correction. Petitioner has filed the subject review petition contending that he has been examined at All India Institute of Medical Sciences and without correction his eyesight is 6/6.

3. By order dated 12.10.2023, this Court had directed the respondents to conduct a fresh medical examination of the petitioner and report his vision without correction.

4. Learned counsel for respondents submits that petitioner was reexamined and has been declared fit in the medical examination.

5. In view of the above, the judgment dated 12.07.2023 is, accordingly, recalled. The writ petition is restored to its original number W.P(C) 9149/2023.

6. Learned counsel for respondents submits that in view of the petitioner being declared medically fit, his case has been forwarded to the Staff Selection Commission (respondent No.3 herein) for permitting the petitioner to participate in the further process of induction.

7. In view of the above, this petition is disposed of declaring the petitioner as medically fit for the purposes of recruitment to the post of Sub Inspector in Delhi Police and Central Armed Police Forces Examination, 2022.

8. Respondent inter alia the Staff Selection Commission (respondent No.3 herein) is accordingly directed to take appropriate steps for recruitment of the petitioner in accordance with law as expeditiously as possible preferably within a period of four weeks from today.

9. Petition is, accordingly, disposed of.
