JUDGMENT
1. Respondent/contemnor has filed an affidavit tendering unconditional apology whereby he has stated as under para 3, para 6 and para 7:- “3.Deponent is here by tendering unconditional apology to this Hon'ble Court and to the Learned Trial Court for an inadvertent remark made by Deponent in Paragraphs 16 and 28(b) of the written submission dated 15.07.2023.
6. That the Deponent is having the blind faith and trust in the Hon’ble Judiciary and has never done any act to malign. Degrade, lower down the majesty and dignity of the Hon’ble Courts and Hon’ble Judges. Deponent did ot make any remark to scandalize or lower down the authority of any court or/and did not have any intention of the same.
7. Deponent apologizes for what he had written in Paragraphs 16 and 28(b) of the written submission dated CONT.CAS.(CRL) 9/2023 15.07.2023. Deponent withdraws the remarks made in Para no.16 and Para no.28(b).”
2. We have also perused the alleged remarks made by him in paragraphs 16 and 28(b) of his written submissions dated 15.7.2023.
3. In view of the unconditional apology tendered by the respondent/contemnor and the undertaking given by him that he shall not commit the same again in future, we, hereby, accept the apology and discharge the respondent/contemnor from the contempt proceedings.
4. It is also directed that the other party, i.e., wife shall not refer said remarks against the respondent/contemnor in future.
5. Petition stands disposed of in aforesaid terms
