JUDGMENT

1. This petition seeks transfer of Execution (Comm) 126/2022 (Rajiv Sinha v. Teneron Ltd.) presently pending before the learned District Judge (Commercial Court)-02, District East, Kakardooma Courts, Delhi, to the ordinary court exercising non-commercial jurisdiction in the District East, Karkadooma Courts.

2. Learned Counsel for the respondents has no objection but prays that as the petitioner is widow of former employee of respondent, it would be appropriate if the dispute is settled amicably be mediation.

3. As such, the dispute would stand referred to the Mediation Centre in the Karkardooma Courts, whom the parties may approach on 9 April 2024 at 2 pm to fix a schedule of mediation. TR.P.(C.) 35/2024

4. The present petition stands allowed accordingly.

5. In case mediation does not succeed, the proceedings would continue from the stage at which they are presently before the learned Transferor court.
