CORAM:
HON'BLE MR. JUSTICE MANMOHAN
29.05.2009 On 11t May, 2009 I had expressed my opinion that impugned eviction order was in accordance with law and called for no interference. However, as I was inclined to grant some time to petitioner to vacate the tenanted premises, petitioner had suggested that she would be satisfied in case she was given one year time from 1st May, 2009 to vacate the tenanted premises.
Today in Court, an affidavit of undertaking has been filed on behalf of petitioner wherein she has undertaken to hand over to respondent physical vacant possession of premises comprising one room with latrine and bathroom on First Floor of House NO. 2005, DDAJanta Flats, Nand Nagri, Delhi (hereinafter referred to as"tenanted premises') on or before 291 May, 2010. Petitioner has also undertaken in the said affidavit that she will neither sub-let nor part with the tenanted premises to any third party. Petitioner
2009:DHC:8510 has also undertaken to this Court that she would pay from today rent at the rate of Rs. 500/- per month to respondent till vacation of tenanted premises. Petitioner has also undertaken in the said affidavit that she would not seek any further time to vacate the tenanted premises.
Learned Counsel for respondent undertakes and assures this Court that respondent would not cause any hindrance or nuisance in petitioners usage of tenanted premises and that respondent would forthwith put back the petitioner in possession of tenanted premises.
The aforesaid undertakings and statements are accepted and shall form part of this order and both parties are held bound to their respective statements.
It is made clear that in case petitioner does not vacate the tenanted premises within the time mentioned in affidavit of undertaking, respondent would be entitled to initiate contempt of court proceedings including seeking of police aid to evict the petitioner.
With the aforesaid directions, present petition and applications are disposed of.
