21.08.2009 Heard both sides. The respondent's counsel has not disputed the existence of the arbitration clause, but he has raised some contentionson merits which cannot be gone into in an application under
Sectionll of the Arbitration and Conciliation Act, 1996. All those contentions will have to be raised before the arbitrator.
I appoint Mr. G.P Thareja, Additional District Judge (Retd.) as the
^ sole arbitrator to adjudicate upon the disputes between the parties.
"7 The fees of the arbitrator is fixed at Rs.1,50,000/- (Rupees One Lakh
Fifty Thousands only)to be shared equally by both the parties.
