1. The petitioner submitted an application to Respondent 1 the Directorate General of Training (DGT) for affiliation of a Multi Skill Training Institute (MSTI) which was proposed to be set up in an area in which there were no earlier Industrial Training Institutes (ITIs) and which is, technically, referred to as an “unserved block”.

Mr. Amitesh Kumar, learned Counsel for the petitioner, has drawn my attention to a communication dated 8 May 2020 from the DGT to the Director, Directorate of Employment and Training, Patna and to the Regional Director, Regional Directorate of Skill Development & Entrepreneurship (RDSDE), Patna, with the subject “Standing Committee Inspection of MSTI (Unserved Block) cases for grant of affiliation”.

3. A reading of the said communication indicates that the Industrial Training Institutes (ITIs), enlisted in the table annexed to the said letter, were to be jointly inspected by the DGT and the authorities in the State of Bihar.

4. Mr. Amitesh Kumar submits that, though this communication was issued on 8 May 2020, it languishes undecided till date, and no joint inspection of the petitioner’s premises has been carried out.

5. Mr. Farman Ali, learned SPC for Respondent 1, submits that, in that event, this writ petition may be disposed of with a direction to the respondents to carry out a joint inspection in accordance with the aforenoted communication dated 8 May 2020, annexed as Annexure P-6 to this writ petition.

In that view of the mater, this writ petition is disposed of with a direction to the respondents to carry out a joint inspection of the petitioner’s premises in accordance with the letter dated 8 May 2020 addressed by the DGT to the Director, Directorate of Employment and Training, Patna and to the Regional Director, Regional Directorate of Skill Development & Enterprises (RDSDE), Patna.

7. Mr. Amitesh Kumar submits that, if the respondents have any misgivings as to whether the petitioner is not situated in an unserved block, a decision to that effect may also be taken.

8. The respondents are directed to carry out a joint inspection and take a decision on the petitioner’s application positively within four weeks and communicate the said decision to the petitioner forthwith.

9. In case any further information or documents are required from the petitioners, the petitioners would be intimated in that regard and they would, in that event, furnish the requisite documents or information forthwith.

10. Should the petitioner continue to remain aggrieved by the decision taken, the rights to avail legal remedies shall stand reserved.

11. The writ petition stands disposed of in the aforesaid terms.
