12.03.2010 Statement of complainant/respondent No.3 - Smt.Shabana
Khatoon, who is accompanied by her sister Rehana, recorded. The complainant is identified by her counsel Sh.Mohd.Asif. A copy of the photo identity card of the complainant has already been placed on record as Annexure P-8, to the petition. According to the complainant, she has received a total sum of Rs.l,16,000/- from the petitioners. This includes the amount of Rs.l6,00p/- received today in the Court. With receipt of this amount, she has received the entire agreed amount of
Rs.l,15,000/- in full and final settlement of all her claims and dues along with Rs.1,000/- as interest for late payment. The complainant has already been divorced by petitioner No.l - Shri Deen Mohd. In view of her settlement, a copy of which has been placed on record, she has desired that FIR No.280/2004 lodged by her at Police Station Welcome under Section 498-A/406/34 of IPG be quashed.

2010:DHC:7279 Since the parties have amicably settled all their disputes and the complainant has already been divorced by petitioner No.l and she has also been duly compensated in respect of all her claims, no useful purpose would be served from continuing the criminal proceedings that were initiated against the petitioners by the complainant. In fact, continuance of criminal proceedings, despite settlement, will be a hindrance in the parties leading their respective life in a peaceful and congenial atmosphere.
Hence, FIR No.280/2004 lodged by complainant at Police Station
^ Welcome under Section 498-A/406/34 of IPG and the proceedings arising therefrom are hereby quashed.
GrI.M.G. 4080/2009 stands disposed of As requested by the complainant, her articles lying in Police
Station Welcome be released to her sister, namely, Rehana, in her presence, under acknowledgment.
