JUDGMENT
The petitioners have filed this Contempt Petition alleging noncompliance of order dated 11th September, 2009 of Division Bench passed in FAO(OS) No. 381/2009. The Division Bench had given directions to the respondent that the General Body of the Samiti shall meet within 15 days for the purpose of filling up the vacancies and after vacancies are filled up the Governing Body shall take up the application of 21 persons, who had applied for life membership of Samiti.
2. The contention of the petitioners is that the applications of 21 persons for life membership of Samiti were taken up by the Governing Body but Samiti wrongfully rejected the applicants’ request for inducting them/enrolling them as lifemember.
3. The directions given by the Division Bench are clear and categorical. The Division Bench had not given directions to governing body to enroll 21 applicants 2010:DHC:1887 CCP No. 181/2010 as life-member. Directions were given only for considering the applications. The applications were considered and the order passed by the Governing Body rejecting their applications was communicated to the applicants including the reasons for rejecting the applications. Thus, no contempt is made out in this case. The petition is hereby dismissed. April 6, 2010 SHIV NARAYAN DHINGRA, J. vn
