The petitioner/tenant is aggrieved bY * the order dated
10.11.2009 passed by the Additional Rent Controller, by which the leave to defend application filed by him in an eviction petition preferred by the respondent/landlord under Section 1a(1)(e) of the
Delhi Rent Control Act was dismissed on the grourld that the same was not filed within the stipulated time and was belated by one day.
Followed by the aforesaid order, the order dated 9.3.2010 was passed, by which the application filed by the petitioner/tenant under Order 37
Rule 4 CPC seeking condonation of delay of one Cay in preferring the leave to defend application was dismissed.
Counsel for the petitioner/tenant seeks leave to withdraw the present petition while reserving the right of the, petitioner/tenant to assail the aforesaid orders in accordance with law. Leave, as prayed for, is granted.
