1. Petitioner is plaintiff before the learned Trial Court and the request in the present petition is merely limited to the effect that the learned Trial Court be requested to expedite the disposal of application moved under Order XII Rule 6 of CPC in a time-bound manner.

2. None has appeared on advance notice.

3. The attention of this Court has been drawn towards various orders passed by learned Trial Court from time to time.

4. It is noted that the arguments on the aforesaid application were, lastly, heard by the learned Trial Court on 19.12.2023. However, thereafter the learned Trial Court has fixed up the matter on various subsequent dates for clarification, if any, and for orders.

5. The next date reportedly before learned Trial Court is 14.08.2024.

6. Keeping in mind the overall facts and circumstances of the case and the CM(M) 2975/2024 2 fact that the arguments were heard way back in December 2023, the present petition is disposed of with the direction to learned Trial Court to seek clarification, if any, from the both the sides on the next date of hearing i.e. 14.08.2024 and thereafter, to dispose the application preferably within four weeks.

7. The present petition stands disposed of in aforesaid terms.
