Counsel for the respondent enters appearance. Counsel for the parties submit that parties have arrived at an'amicable settlement.
As per the settlement, appellant has agreed to pay a total sum of
~6,00,000/- in full and final settlement of all claims and dues and in satisfaction of the decree, . to the respondent. Respondent has accepted the offer of the appellant. It has further been agreed that a sum of ~2,00,000/- shall be paid by way of acheque today itself and the balance sum of ~4,00,000/- shall be paid within a period of one and a half montt) from today. In case the total surn. of ~6,00,000/- is not paid within one and a half month, as stated above, the respondent will be entitled to execute the decree as per law. The statement of the appellant and the statement of the counsel for the respondent to this effect have been recorded separately.
In view of the settlement arrived and the statements recorded, which are accepted and taken on record; and the fact that in addition to other reme_dies which may be available.to the respondent, in case· the amount as agreed is not paid within the time fixed, 'respondent would be en~itled to execute the entire decree, present appeal and the application stand disposed of.·
