UOI & ORS Respondents
Through: Mr. Ramesh Ray, Advocate for R-l/UOI.
CORAM:
HON'BLE MR. JUSTICE P.K. BHASIN
23.12.2010 Counsel for respondent No.1 today informs that in the other cases of village
Shahbad Daulatpur which were remanded back by a division bench of this Court vide its
ORDER
dated 6t!1 February, 2008, the Reference Court has once again maintained the market value of the land in the said village at Rs. 1,67,000/- per bigha vide its judgment dated 31 " March, 2009 and the same market value had earlier also been fixed by the
Reference Court which was challenged before this Court. Counsel submits that because of the fact that even after remand the Reference Court has not given any enhancement in compensation to other land owners the appellant of the present case for that reason may not be interested in prosecuting this appeal and that is why there is no appearance on his behalf in this appeal on the last many dates.
This appeal is dismissed for non-prosecution.
