1. Petitioner had filed a Guardianship Petition before the learned Trial Court and is aggrieved by order dated 23.05.2023 whereby her request seeking interim custody of her child has been declined.

2. However, learned counsel for the petitioner has, very fairly, submitted that the aforesaid Guardianship Petition i.e. GP No.39/2022 has already been finally disposed of by the learned Trial Court vide order dated 19.01.2024 and the petitioner has already challenged the final order by filing a MAT Appeal. He states that he would raise challenge with respect to the order, which has been impugned herein, in the aforesaid MAT Appeal and, therefore, he states that to the above extent, he does not press the present petition. 3. The present application is, accordingly, disposed of in view of the above.

4. All rights and contentions of the parties are reserved.

5. Petitioner would be at liberty to agitate the order, which is impugned before this Court, during course of the arguments of the aforesaid MAT Appeal.
