Present: Mr. Rajat Aneja, Ms. Shweta Singh, Advs. for the petitioners.
Mr. U.L. Watwani, APP for the State-respondent no.1 along with SI Gopi Ra.ln, P.S. Vasant Vihar.
Respondent no. 2 in person.
+ Crl. M.A. 18326/2010 (Exemption)
*
Allowed, subject to all just exceptions.
Application stands disposed of.
+ Crl. M.C. 3812/2010
It appears that a quarrel took place between the petitioners on the one hand and respondent no. 2 on the other. Petitioner no. 1 and respondent no. 2 sustained injuries in the said quarrel. Cross cases were registered. On the complaint of respondent no.2, FIR NO. 573/2006 under Sections 325/452/34 IPS was registered at Police
Station Vasant Vihar. Petitioner no. 1 filed a petition under Section
156(3) Cr.P.C. pursuant whereof FIR No. 189/2007 under Sections
308/342/34 IPC had been registered at Police Station Vasant Vihar.
After investigation closure report has been filed in FIR NO. 189/2007. As regards the FIR No. 573/2006 is concerned, charge- sheet has been filed.
Now, petitioners and respondent no.2 have resolved their
2010:DHC:9131 disputes amicably with the intervention of their common friends.
Petitioners has agreed not to file any protest petition against this closure report in FIR No.189/2007. Petitioner states that he has no objection if closure report is accepted by the Metropolitan Magistrate.
Similarly, respondent no. 2 has ·agreed not to pursue the FIR in question. Respondent no. 2, who is present in court, submits that he has no objection if the FIR in question is quashed.
Since, both the parties have settled their disputes amicably, in my view, no fruitful purpose would be served in compelling them to continue to litigate a protracted trial. Accordingly, in the larger interest, FIR No.573/2006 under Sections 325/452/34 IPS registered at Police Station Vasant Vihar and consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
