The impugned notice is dated 13.12.2010. Allegations are that the vehicle of the petitioner was involved in a fatal accident on
5.4.2010. His permit was suspended for a period of 45 days vide order dated 2.11.2010. In appeal before the Appellate Tribunal the period of suspension was reduced from 45 days to 43 days.
Counsel for the petitioner states that the period may further be reduced on sympathetic consideration. Counsel for the respondent has vehemently opposed this submission.
At this stage, counsel for the petitioner seeks permission of this court to withdraw the petition.
Petition is dismissed as withdrawn with the direction that the vehicle shall be surrendered by the petitioner and after the suspension period is over, vehicle be returned bacM to him.
