27.01.2011 This petition has been preferred by the petitioner assailing an order passed by learned Sessions Judge dated 9"^ August, 2010 whereby the appeal of the petitioner against the order of learned CMM was dismissed on the ground of maintainability. The learned CMM, before whom an application was made to declare the petitioner as a Juvenile, had come to conclusion that the petitioner was not a Juvenile. I consider that since the matter has already been committed to Sessions Court, the Sessions Court shall consider the merits of decision of learned CMM and shall pass an order in respect of the Juvenility of the petitioner on petitioner's making fresh revision before the Sessions Court where the case is committed. The delay in filing the revision, ifany, shall be cqndoned.
The petition stands disposed of.
