JUDGMENT
1. Petitioner has filed a suit for permanent injunction against her son.
2. Suit was first listed for consideration on 11th July, 2024 but nothing happened as Bar was on strike.
3. On 16th July, 2024 as well, since the Bar continued to be on strike, the matter was again adjourned for 15th October, 2024.
4. The petitioner moved an application seeking early hearing but such request has not been acceded to.
5. It is contended that the court has yet not issued the summons of the suit and notice of the interim application.
6. According to petitioner, there is an urgency in the matter, as the petitioner is 88 years old lady and seeking a decree of permanent injunction against her son from interfering with her peaceful possession or from CM(M) 3310/2024 2 dispossessing her from the suit property without following the due process of law.
7. Keeping in mind the overall facts of the case and also keeping in mind the age of the petitioner, who is stated to be 88 years old woman, the petition is disposed of with the liberty to petitioner to move application afresh, seeking early hearing and let such application be placed before the learned Trial Court and be heard on 6th September, 2024.
8. The present petition is accordingly, disposed of in the aforesaid terms.
