JUDGMENT
1. The dispute between the parties stands referred to arbitration by this Court by order dated 2 September 2024 in Arb P 1013/2024.
2. Mr. Ashim Shridhar, learned Counsel for the petitioner, submits that this petition could be referred to the appointed arbitrator to be treated as an application under Section 17 of the Arbitration and Conciliation Act 1996[1] and disposed of accordingly.
3. Learned Counsel for the respondent has no objection.
4. In these circumstances, this petition is relegated to the learned arbitrator appointed by order dated 2 September 2024 in Arb P “the 1996 Act”, hereinafter O.M.P.(I) (COMM.) 297/2024 1013/2024 to be disposed of treating it as an application under Section 17 of the 1996 Act.
5. This Court has not expressed any opinion on the merits of the matter.
6. The petition stands disposed of in the aforesaid terms.
7. IA 38330/2024 does not survive for consideration and also stands disposed of.
