JUDGMENT
1. This hearing has been done through hybrid mode.
2. This is a writ petition filed by the Petitioner- Kailash Harijan seeking production of his daughter- Ms. ‘X’ and grandson who are stated to be missing since 4th November, 2023.
3. The matter was mentioned today by Mr. Lao, ld. Standing Counsel and an application has been moved being Crl. M.A. ………./2024 (to be 15:33 numbered) with respect to early hearing of the present petition. The Court has been informed that the daughter- Ms. ‘X’ and the grandson of the Petitioner have been traced in Bihar and they have been produced before the Court today. The Petitioner is also present before the Court.
4. A status report dated 13th September, 2024 authored by the Anti Human Trafficking Unit (‘AHTU’) has been handed over in Court today and the same has been taken on record. As per the said status report, on 12th September, 2024, the missing girl and her son were found from the house of her brother namely, Amresh Kumar who resides in Village Badhara Kothi, P.S. Badhara, District Pruraniya, Bihar.
5. The daughter of the Petitioner has no objection in going back to her father/Petitioner’s house. Ms. ‘X’ further states that she was married to Mr. Boku Mehter in Bihar. The Petitioner submits that the daughter-Ms. ‘X’ would be sent to her matrimonial home after the Chhatt Pooja.
6. The daughter has then accompanied the father/Petitioner.
7. The Petitioner has requested that his daughter be medically examined and given treatment as she seems to be mentally disturbed.
8. In view of the same, the SHO concerned shall assist the father/Petitioner in making his daughter-Ms. ‘X’ obtain medical treatment at the Janakpuri Super Speciality Hospital by presenting this order with the Petitioner and his daughter-Ms. ‘X’ to the concerned Medical Superintendent for one visit. Thereafter the hospital shall continue to provide treatment to her.
9. The petition is disposed of accordingly.
10. Pending application(s), if any, also stand disposed of.
11. The Court would like to place on record its appreciation to the invaluable assistance that has been given and the work that has been 15:33 undertaken by W/SI Bimla, ASI Gopal Krishan, Ct. Dharm Raj and W/Ct. Mintu for the incessant efforts in tracing out the girl-Ms. ‘X’ and the grandson of the Petitioner.
12. Next date of hearing shall stand cancelled.
