debtor has agreed to pay 19 outstanding equated monthly installments in respect of the home equity loan as per the tabulation contained in said memorandum. The parties have also agreed that in case of two consecutive defaults in payment of the
EMIs, the decree holder shall be entitled to initiate fresh execution proceedings immediately for recovery of the awarded amount under the decree.
It has been agreed between the parties that the decree holder shall withdraw the present execution petition and the judgment debtor shall withdraw O.M.P. No.150/2011 (objections under section 34 of the
Act) upon the settlement being recorded.
2011:DHC:13163 r In view of the aforesaid position, the aforesaid settlement is tal<en on record. The parties undertake to remain bound by the terms thereof. The settlement shall bind the parties.
Petition stands disposed of.
