JUDGMENT

1. The petitioner is defending a Civil Suit and is aggrieved by order dated 4th December, 2021, 10th November, 2022 and 22nd May, 2024.

2. Learned counsel for the respondent/plaintiff appears on advance notice.

3. After hearing the arguments for some time, learned counsel for the petitioner states the he is ready to clear the cost of Rs.25,000/- on the next date of hearing, which is stated to be 1st October, 2024.

4. The petition is thus disposed of with direction to clear the cost on or before 1st October, 2024 and petitioner is permitted to cross-examine PW[2] and PW[3].

5. Learned counsel for the respondent/plaintiff states that he would take steps to summon PW[2] and PW[3] for the purposes of cross-examination by the CM(M) 3456/2024 2 defendant.

6. It is, however, also made clear that any travelling expenditure to be incurred by PW[2] and PW[3], would also be borne by the petitioner herein.

7. Needless to say, the petitioner i.e. defendant, would also be at liberty to lead his evidence and learned Trial Court would accordingly, give suitable dates after cross-examination of PW[2] and PW[3].

8. Since the case was filed in the year 2012, learned Trial Court is also requested to give short dates and to make best endeavour to dispose of the case as expeditiously as possible.

9. The present petition stands disposed of in aforesaid terms.
