CORAM:
HON'BLE MR. JUSTICE MANMOHAN
01.06.2011 The present petition has been filed under Section 560 of the
Companies Act, 1956 for restoration of petitioner-company.
Mrs. Richa Kukreja, Deputy Registrar of Companies appearing for respondent states that she has no objection to the name of the petitioner-company being restored provided petitioner-company files pending statutory returns, i.e., Annual Returns and Balance Sheets and pays additional fee as prescribed under law. The petitioner-company has already filed no objection from other shareholders and directors of company along with petition.
CO.PET 21512011 Page 1 of2 2011:DHC:7034 Keeping in view the fact that the Annual Returns and Balance
Sheets have not been filed by the petitioner-company for a period of nearly fourteen years, Mr. Pradeep K. Mittal, learned counsel for petitioner-company himself states that petitioner-company would pay additional costs of Rs. 1,00,000/- to respondent.
Accordingly, upon payment of costs of Rs. 1,00,000/- within a period of six weeks, the name of the petitioner-company shall stand restored and its status would be changed from inactive to active company. Petitioner-company is granted four weeks' time to file statutory documents, like Annual Returns and Balance Sheets for the outstanding period along with the prescribed fees in accordance with law.
With the aforesaid observations, present petition and application stand disposed of. iLL
