ORDER
1 The instant appeals pertain to lands situated in the • revenue estate of village Ghewra, and the notification under Section 4 of the Land Acquisition Act 1894 with which I am concerned was issued on 6.2.2003.
2. The Reference Court has assessed the compensation @ fl[9],11,311/- per acre besides other statutory benefits as per the Land Acquisition Act 1894. This comes to less than 4,03,425/per big ha.
3. Deciding a batch of appeals lead matter being LA.APP 2011:DHC:12743 'V No.489/2008 Chiranli La! Vs. UQI & Anr. today itself, with reference to a decision dated 19.12.2008 passed by a Division Bench deciding LA.APP.No.193/2006 PrataQ Sfngh (through LRs) Vs. UQI & Ors. I have determined the fair market value of the lands in village Ghevra at 4,03,425/- per bigha as of 6.2.2003.
4. Land Acquisition Appeal Nos.456/2009, 457/2009, 525/2009, 526/2009, 569/2009, 590/2009, 592/2009, 612/2009, 614/2009, 157/2011, 162/2011 and 265/2011 stand disposed of decreeing the same enhancing the compensation payable to the • appellants @ 4,03,425/- per bigha; additionally decreed that the appellants would be entitled to the statutory benefits as per the Land Acquisition Act 1894 including the decision of the Supreme Court reported as 93 (2001) DLT 569 Sunder Vs. Un/on of !ndia. The appellants thereof would also be entitled to proportionate costs.
5. LA.APP.Nos.135/2010, 136/2010, 137/2010, 138/2010, 139/2010, 140/2010, 141/2010, 142/2010, 143/2010, 144/2010, 146/2010, 147/2010, 148/2010, 149/2010, 150/2010, 151/2010, 152/2010, 153/2010, 234/2011 and 237/2011 filed by the Union • of India are dismissed.
6. Pending applications, if any, in the appeals stand disposed of in terms of the prayer made in the application.
7. Cross objections, if any, in the appeals are dismissed.
