Present petition has been filed under Section 482 Cr. P.C. for quashing of FIR No. 205/2010 registered under Sections
406/420/34 IPG at P.S. Paharganj on the complaint of respondent
No.2. The disputes involved in the FIR are regarding sale of property bearing No. 10072-76, Gali No. 1, Multani Dhanda, Paharganj, New Delhi. Respondent No.2 was the purchaser whereas petitioners NO. 1 to 9 were the sellers. Respondent No.2 is related to the petitioners.
It appears that certain portion of the property was not havmg clear title on account of it being mortgaged with the bank. After getting the mortgage redeemed, the petitioners have now executed sale deed with regard to the entire property.
The parties have now amicably settled their disputes. It has been admitted by respondent No.2 that sale deed has been
I registered. Respondent No. 2 who is present in court and duly
2011:DHC:11219 identified by Investigating Officer SI Amrish Giri, P.S. Paharganj. states that he has no objection to the quashing of FIR. !
Keeping in mind the fact that the parties are related to each other and they have amica:bly settled their disputes, inasmuch as, the sale deed has been executed, no fruitful purpose would be served by keeping the criminal proceedings pending in the court. In the larger interest, FIR No. 205/2010, P.S. Paharganj, registered under Sections 406/420/34 IPG and all proceedings arising therefrom are hereby quashed.
