JUDGMENT
Exemption allowed, subject to all just exceptions.
1. Petitioner has filed a suit for damages, declaration and injunction.
2. It is apprised that the suit is at the stage of final arguments since the year 2018 and the prayer in the present petition is merely limited to the effect that learned Trial Court may be requested to hear and decide the above-said suit in a time-bound manner.
3. Attention of the Court has been drawn towards various orders.
4. Nobody appears on behalf of the other respondents despite service of advance notice.
5. This suit was earlier filed before this Court on its original side and with the change in the pecuniary jurisdiction, it got transferred to District Courts. CM(M) 3511/2024 2
6. Admittedly, case was taken up in the year 2018 for final arguments but such arguments have yet not been heard fully and concluded. It is apprised that matter remained part-heard on few occasion as well.
7. Next date of hearing before the learned Trial Court is stated to be 04.12.2024.
8. Though without appreciating the exact workload and board position of the concerned learned Trial Court, it may not be proper to give any time-bound frame for disposal but keeping in the fact that the suit is of year 2007 and is running for final arguments since the year 2018, present petition is disposed with the request to learned Trial Court to make best endeavour to dispose of the above-said suit as expeditiously as possible and preferably within four months from the date fixed before it i.e. 04.12.2024.
9. Petition stands disposed of in the aforesaid terms.
