04.07.2011 By this petition the Petitioner seeks parole on the ground that he wants to file SLP. The Petitioner has been convicted for offence under Section
392/34 IPC and awarded sentence of imprisonment for three years and fine of Rs. 1,000/-. The Petitioner had undergone approximately 5 months undertrial period and thereafter the sentence was suspended when the appeal was filed before this Court. After the appeal was dismissed on 2"^^
December, 2010 the Petitioner had surrendered only on 16^*^ December,
ORDER
2010. Thus, he has been in custody only for the last 7 months. This case is W.P.(CRL) 791/2011 2011:DHC:17957 not covered by the decision of the Hon'ble Supreme Court in Inder Singh Vs. State ofDelhi AIR 1978 SC 1091. As regards fihng of SLP before the Hon'ble Supreme Court is concerned, a status report has been field which shows that the family of the Petitioner comprises of his father, wife, brother and sister-in-law. The brother and sister-in-law of the Petitioner are Government servants. Since the Petitioner's family is in a position to engage a lawyer, I do not find it a fit case to grant parole for filing SLP. Petition is dismissed. Copy of the order be sent to the Petitioner through Superintendent Tihar Jail.
