Petitioner has impugned the order dated 04.1.2011 vide which the trial judge had allowed the application under Order VI Rule 17 of the
Code of Civil Procedure (hereinafter referred to as 'the Code') filed by the plaintiff whereby he had been permitted to amend his plaint. Written statement had been permitted to be filed within four weeks thereafter.
After some arguments learned counsel for the petitioner states that he is not pressing his petition but time may be extended to file his amended written statement. Time is accordingly extended; amended written statement be filed within the period of two weeks to be counted from today i.e. by 18.7.2011. Petition is disposed of.
Counsel for the petitioner seeks waiver of the cost imposed by the concerned court vide order dated 23.4.2011. He is permitted to move appropriate application in this regard before the concern d court.
