JUDGMENT
1. This application has been jointly filed by the parties under Order
23 Rule 3 of the CPC placing a settlement arrived at between them on record. It is stated that in terms of the settlement, plaintiff had agreed to receive a sum of Rs.1,10,00,000/- in full and final settlement of the suit claim of the plaintiff. A copy of the settlement deed dated 15'^ June, 2011signed by the parties has been placed on record as annexure 'A' to the application. The plaintiff has confirmed the satisfaction of the settlement and has recorded that it has already received the agreed amount by way of cheque no.015632 dated 14*^*^ June, 2011 at the time 2011:DHC:1956[3],rp- - 2 of execution of the settlement deed.
2. Learned counsel for the plaintiff submits that in view of the settlement between the parties, he may be permitted to withdraw the suit. This application is allowed. CS(OS) No. 2227/2010
