The petitioner had withdrawn the suit on 21.4.2011.
Separate statement of the counsel for the plaintiff had also been recorded. By this petition it is contended that inadvertently no opportunity has been sought by the plaintiff at that time, to file a fresh suit. Learned counsel for the petitioner has drawn attention of the Court to para 27 of the plaint wherein the valuation of the suit has been fixed at 300/-; it is pointed out that this was the reason for the withdrawn of the suit. Be that at it may, the petitioner is granted liberty to file a fresh suit on the same cause of action. Petition is disposed of in the above terms.
