ORDER

1. This is a petition seeking speedy trial in respect of the FIR NO. 55/2008 under Section 21/29/61/85 NDPS Act registered by P.S. Special Cell, Lodhi Colony, Delhi. It has been stated in the petition that the petitioner is in custody since 06.09.2008 and the trial is going on snail pace and out of 12 witnesses only 3 witnesses have been examined. The State was called upon to file the status report. The status report shows that the number of witnesses who have been examined were not given correctly in the petition. As a matter of fact, out of 18 witnesses, 11 witnesses were examined by the time the petition was filed. The learned counsel for the petitioner has stated that she will obtain instructions from the petitioner regarding the factum as to whether 11 witnesses have been examined or not. However, 2011:DHC:10535 she has stated that she is unable to contact the petitioner and consequently, she Is not able to obtain the instructions.

2. Be that as it may, in the light of the fact that out of 18 witnesses, 11 witnesses have already been examined and the matter is listed in the month of August, 2011. I think no order is required in the petition except that the learned Magistrate shall try to expedite the trial, keeping in view the fact that petitioner is in jail. JULY 22, 2011 KP V.K. SHALI,J
