V 1. * Present petition has been filed for quashing the F.I.R.
No.75/2009 dated 12.03.2009 registered at P.S. Uttam Nagar under Section 308/34 of the I.P.C. against the petitioners.
ORDER
2. Ld. APP for the State states that after investigation, the charge sheet was filed by the State and that the charge has already been framed. The case is pending for prosecution evidence. 2011:DHC:15526
3. Ld. Counsel for the petitioners submits that with the intervention of sonne well wishers and relatives of the parties, the matter was amicably settled between them regarding the present F.I.R. No.75/2009 and a compromise has been entered into between them dated 30.05.2011, which is placed on record.
4. The petitioners and the complainant are staying in the same locality. Respondent No.2, who is present in the Court, states that he does not wish to pursue the matter and also states that he has no objection to the quashing of the aforesaid FIR.
5. Since the matter has been compromised between the parties and more so the day of incident was a 'Holi' day. The petitioners have now realized their mistake.
6. In view of the above, the F.I.R. No.75/2009 dated 12.03.2009 registered against the petitioners at P.S. Uttam Nagar under Section 308/34 of the I.P.C. and all proceedings > emanating therefrom are quashed.
7. Since, the police has been used and the precious time of this Court has also been wasted, I impose the cost of T10,000/each on the petitioners which shall be deposited with the Advocates Welfare Fund, Delhi Bar Council, within a weel<. Proof of the same shall be placed on record. 2^
