HON'BLE MR. JUSTICE P.K. BHASIN
29.07.2011 Today counsel for the petitioner has submitted that this Court need not dispose of this petition on merits since the petitioner has decided to vacate the tenanted premises. However, counsel submits, the petitioner is a widow having tliree children to support and only source of earning for her family through the shop in question and so she may be permitted to surrender the possession of the tenanted premises to respondent-landlord within one year from today and she undertakes to vacate the premises within that period. It is further submitted that during this extended period of stay the petitioner-tenant would pay to the respondent a sum of ? 3,000 per month as against the agreed rent of ? 733 per month regularly on or before 7"^ of each month and in case of any default this
Court can order immediate eviction ofthe petitioner from tenanted premises.
Though counsel for the respondent is not agreeable to that much time being given to the petitioner but talcing into consideration the aforesaid submissions of the counsel for the petitioner I grant one year's time to her from today to vacate on the aforesaid conditions volunteered by the petitioner herself and which she has undertaken to honour and which oral undertaking is accepted.
This petition stands disposed of accordingly.
